Welcome to IMPLAN Data Exporter. These Terms of Service ("Terms") govern your access to and use of our service. By accessing or using our service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing our website, or using our Chrome extension, you agree to these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree with these Terms, you must not use our service.

We reserve the right to modify these Terms at any time. Continued use of the service after changes constitutes acceptance of the modified Terms.

2. Service Description

IMPLAN Data Exporter ("the Service") provides:

  • Automated data extraction from IMPLAN.com economic impact analysis results
  • Export of IMPLAN data to Excel format with multiple pivot dimensions
  • Chrome extension to capture and sync IMPLAN session credentials
  • Secure credential caching for seamless data downloads
  • Subscription-based access to advanced features

The Service is provided "as is" and we make no warranties about its availability, reliability, or fitness for any particular purpose.

3. Eligibility

You must be at least 13 years old to use this Service. By using the Service, you represent and warrant that:

  • You meet the minimum age requirement
  • You have the legal capacity to enter into these Terms
  • You will provide accurate and complete registration information
  • You have a valid IMPLAN account and subscription
  • Your use complies with all applicable laws and regulations

4. Account Registration

4.1 Account Creation

To use the Service, you must create an account by providing:

5. IMPLAN Account and Credentials

5.1 IMPLAN Subscription Requirement

This Service requires a valid, active IMPLAN subscription. You must:

  • Have your own IMPLAN account in good standing
  • Comply with IMPLAN's terms of service
  • Not share IMPLAN credentials with others
  • Maintain an active IMPLAN subscription to use our Service

5.2 Credential Handling

Our Chrome extension captures your IMPLAN session credentials to facilitate data downloads. By using our Service, you authorize us to:

  • Capture your IMPLAN session cookies when you visit IMPLAN.com
  • Temporarily store these credentials in encrypted cache
  • Use these credentials to download data on your behalf
  • Automatically delete credentials after session expiration (10 minutes of inactivity)

Important: We do not store your IMPLAN password. We only cache temporary session credentials.

5.3 No Affiliation with IMPLAN

IMPLAN Data Exporter is not affiliated with, endorsed by, or sponsored by IMPLAN Group LLC. This is an independent third-party service that facilitates data export from IMPLAN.com. Use of our Service does not grant you any rights to IMPLAN's platform, data, or services.

6. Subscription and Payment Terms

6.1 Free Tier

We offer a limited free tier that allows basic data downloads without pivot dimensions. Free tier users may be subject to:

  • Download limits
  • Reduced features
  • Service restrictions

6.2 Paid Subscriptions

Paid subscriptions unlock advanced features including:

  • Multiple pivot dimensions (groups, events, tags)
  • Unlimited downloads
  • Priority support
  • Advanced export options

6.3 Payment Processing

All payments are processed securely through Stripe. By subscribing, you agree to:

  • Provide valid payment information
  • Authorize recurring charges for subscription periods
  • Maintain current payment information
  • Pay all applicable taxes

6.4 Billing and Renewal

  • Billing Cycle: Subscriptions are billed monthly or annually based on your plan
  • Auto-Renewal: Subscriptions automatically renew unless cancelled
  • Price Changes: We will notify you 30 days before any price increases
  • Failed Payments: Service may be suspended if payment fails

6.5 Cancellation and Refunds

  • You may cancel your subscription at any time through your account settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial months or unused service
  • We may offer refunds at our discretion for service issues

7. Acceptable Use Policy

7.1 Permitted Use

You may use the Service to:

  • Download data from your own IMPLAN analyses
  • Export data in accordance with IMPLAN's terms of service
  • Use downloaded data for legitimate business or research purposes

7.2 Prohibited Activities

You must NOT:

  • Use the Service to access IMPLAN accounts you do not own
  • Share your account credentials with others
  • Attempt to reverse engineer, decompile, or hack the Service
  • Use automated tools (bots, scrapers) to abuse the Service
  • Exceed reasonable download limits or abuse fair use
  • Resell, redistribute, or commercially exploit downloaded data without proper rights
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Upload malware, viruses, or malicious code
  • Interfere with the Service's operation or other users' access

8. Intellectual Property

8.1 Our Rights

IMPLAN Data Exporter and all related software, code, design, and content are owned by us or our licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service. You may not:

  • Copy, modify, or distribute our software or content
  • Remove copyright or proprietary notices
  • Create derivative works
  • Use our trademarks without permission

8.2 Your Data

You retain all rights to data you download from IMPLAN through our Service, subject to IMPLAN's terms and applicable data licensing agreements. We claim no ownership over IMPLAN's data or your analyses.

8.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide license to use, modify, and incorporate such feedback without compensation or attribution.

9. Data and Privacy

Your use of the Service is governed by our Privacy Policy, which explains how we collect, use, and protect your information. Key points:

  • We encrypt IMPLAN credentials in transit and at rest
  • Credentials are automatically deleted after session expiration

  • Uninterrupted or error-free access
  • Compatibility with all IMPLAN versions

  • Protection from data loss or corruption

10.2 Third-Party Dependencies

Our Service depends on third parties including IMPLAN, Stripe, and hosting providers. We are not responsible for:

  • IMPLAN service outages or changes to their API
  • Payment processing issues
  • Infrastructure failures beyond our control

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
  • WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID IN THE LAST 12 MONTHS

10.4 Data Accuracy Disclaimer

While we strive for accurate data export, we are not responsible for:

  • Errors in IMPLAN's source data
  • Formatting or calculation discrepancies
  • Data loss during download or export
  • Decisions made based on exported data

You are responsible for verifying the accuracy of all exported data.

11. Indemnification

You agree to indemnify, defend, and hold harmless IMPLAN Data Exporter, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including IMPLAN's terms
  • Your unauthorized use of IMPLAN credentials
  • Any content you submit or actions you take using the Service

12. Term and Termination

These Terms remain in effect while you use the Service.

You may terminate your account at any time by:

13. Dispute Resolution

13.1 Informal Resolution

Before filing a legal claim, you agree to contact us at support@implan-tool.com to attempt to resolve the dispute informally.

13.2 Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

13.3 Arbitration

Any disputes that cannot be resolved informally will be resolved through binding arbitration in accordance with the American Arbitration Association's rules. You waive your right to a jury trial or to participate in a class action lawsuit.

14. Chrome Extension

14.1 Installation and Permissions

Our Chrome extension requires certain permissions to function:

  • Cookies: To capture IMPLAN session credentials
  • Active Tab: To detect when you're on IMPLAN.com
  • Storage: To temporarily cache credentials

By installing the extension, you grant these permissions and authorize credential capture.

14.2 Extension Updates

The extension may automatically update to add features, fix bugs, or maintain compatibility. Continued use after updates constitutes acceptance of the updated version.

14.3 Uninstallation

You may uninstall the Chrome extension at any time through Chrome's extension management. Uninstalling the extension will prevent credential capture but will not delete your account.

15. Changes to Service

We reserve the right to:

  • Modify, suspend, or discontinue any part of the Service
  • Change pricing with 30 days' notice
  • Add or remove features
  • Impose usage limits

We will make reasonable efforts to notify you of material changes.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and IMPLAN Data Exporter.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

16.3 No Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

16.4 Assignment

You may not assign these Terms without our consent. We may assign these Terms to any successor or affiliate.

16.5 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control (natural disasters, wars, pandemics, internet outages, etc.).
